Conditions of Use
We stand behind our products and offer a 100% Customer Satisfaction Guarantee. We will refund your money if the item is returned in as sold condition within 15 days of purchase. We reserve the right to not refund return shipping as well as charge a restocking fee, or deny refund, for any merchandise returned in not as sold condition or if only part of the parcel or item is returned instead of the purchase in its entirety. If stone is not exactly as described we will issue a 100% refund for the cost of the stone and shipping, although shipping back to us will be the Buyer's responsibility but will be credited to the Buyers account for future purchases. If a Gemstone tests out to be a different stone then as sold or to be synthetic (unless sold as syn.) we will issue a refund immediately upon receiving the item back in as sold condition with the report from a proper lab or Gemologist stating it is not real or not as it was sold; the refund amount is limited to the selling price and shipping combined and nothing further. All Returns must be sent with Delivery Confirmation and Insurance for the final selling price.
Independent and reputable lab reports can be supplied on any stones for an extra fee, fee(s) depend on the Lab chosen and the type of report requested. Any stones requesting a report on will require a non-refundable down payment on the stone itself in the amount of the Lab Report costs, but this down payment, although non-refundable, will actually be refunded to the Buyer in the event that the stone does indeed test out differently then advertised. The non-refundable down payment will be applied to the total purchase price of the purchase.

GEMSBYJENNIFER TERMS OF SERVICE (TOS)
Use of GemsByJennifer’s Services constitutes acceptance and agreement to GemsByJennifer’s AUP (Acceptable Use Policy) as well as GemsByJennifer’s TOS (Terms of Service). From herewith in this TOS, AUP, and SLA, the usage of "us", "we", "our", and "ours" shall constitute reference to GemsByJennifer and/or any representative thereof, and the usage of "you", "your", "they", and "them" shall refer to client / customer of GemsByJennifer.
Acceptance of Contractual Agreement
1. Client agrees that by placing an order either by means of electronic ordering (web order form) or submitting a written contract, and receipt of such order by GemsByJennifer, that you are agreeing to our TOS, AUP, and SLA. No modifications of said contract by customer are allowed.
2. GemsByJennifer will provide, and Customer will purchase and pay for, the Services, the product, and/or service/product fees specified in the Order for the applicable Service/Product Description. Customer acknowledges that the service/product and service/product fees have been communicated to the customer, and that he/she is aware of all applicable charges as per contract, AUP, SLA, and TOS. Customer also understands that any promotional offers unless specified in contractual terms will not be applicable to their individual service/product.
3. In connection with any Hosting Services, if Customer's actual bandwidth usage in any month exceeds allotted amount, specified in Customer's contract, Customer will pay GemsByJennifer any additional fees as specified in the Service Description. If you do not pay, GemsByJennifer reserves the right to suspend your account until payment is received.
Establishment of this service/product is contingent upon receipt of payment from Customer to GemsByJennifer.
Payments and Fees:
Payment is due on the defined billing.
GemsByJennifer reserves the right to suspend accounts that reach 10 days past due date.
GemsByJennifer may temporarily deny service/product or terminate this Agreement upon failure of Customer to pay charges when due. Such termination or denial will not relieve Customer of responsibility for the payment of all accrued service/product fees, or any collection of fees. GemsByJennifer reserves the right to charge interest at 5% per month until the outstanding balance is paid in full. If Customer's account is overdue for 90 days, the account will be handed over to an outside collection agency. At that time the Customer will incur a US250.00 collection fee added to the balance previously due.
All requests for cancellation of any service / services must be made in writing with at least 30 days notice but not more than 60 days prior written notice and emailed to firstname.lastname@example.org. Confirmation receipt of cancellation will be sent within 48 hours.
Refunds and Disputes:
All payments to GemsByJennifer are non-refundable after Customer's 15-day money-back guarantee period. All billing disputes must be reported within 30 days of the time the dispute occurred.
Reliability of Service/product/website Usage:
GemsByJennifer will use its best efforts to maintain a full time Internet presence for the Customer. The Customer hereby acknowledges that the network may, at various time intervals, be down due, but not restricted to, utility interruption, equipment failure, natural disaster, acts of God, or human error. In no event shall GemsByJennifer be liable to the Customer for any damages resulting from or related to any failure or delay of GemsByJennifer in providing access to the Internet Website, their account(s), record(s), payment(s), or any other services offered by GemsByJennifer under this Agreement. In no event shall GemsByJennifer or any representative thereof be liable to the Customer for any indirect, special or consequential damages or losses or lost profits arising out of or related to this Agreement or the performance or breach thereof. The aggregate, total liability of GemsByJennifer and/or its or any representatives under this Agreement, if any, shall in no event or circumstance exceed the total amount actually paid by the Customer hereunder or in excess ot a total amount of $100. The terms of this Section will survive any termination of this Agreement.
GemsByJennifer reserves the right to change the above rules/conditions at any time.
